What happened

The Financial Wire reported on October 19 on a proposed $162 million class action settlement in Calderon v. Public Partnerships, LLC, a federal case in the Eastern District of New York. Public Partnerships (PPL) became the single statewide fiscal intermediary for New York's Consumer Directed Personal Assistance Program (CDPAP) in 2025.

The settlement covers about 200,000 personal assistants who worked in New York City, Nassau, Suffolk or Westchester between March 1, 2025 and April 30, 2026. The case claimed aides in those counties were owed wage parity pay that was not fully passed through. Payments would average about $680, and eligible aides do not need to file a claim. The deal also ends a minimum essential coverage health plan that had been offered in place of some wage parity pay. A final approval hearing is set for November 10. The settlement administrator, Atticus, can be reached at 1-800-314-2601, and the Legal Aid Society has posted the official notice.

What it means for families

Many CDPAP aides are family members or friends of the person they care for. If your relative's aide worked downstate during that period, the aide may be owed money without doing anything.

For example: a daughter in Queens who is paid through CDPAP to care for her mother could receive a payment by mail, so her current address on file matters.

What this means in New York: the settlement covers downstate wage parity counties only. Aides in upstate and Western New York counties are not part of this class.

What to do this week

  • If you or your relative's aide worked through CDPAP in NYC, Nassau, Suffolk or Westchester, read the Legal Aid notice to confirm eligibility.
  • Make sure PPL has the aide's current mailing address so a payment is not lost.
  • Call the administrator at 1-800-314-2601 with questions before November 10.
